These Terms of Use ("Terms") form a binding agreement between you and Nullset Studio ("we", "us", "our"), the operator of XPGym (the "App"). By creating an account, accessing, or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
You must be at least 16 years old (or the minimum age of digital consent in your country) to use the App. If you are under the age of majority where you live, you may only use the App with the involvement and consent of a parent or legal guardian. By using the App you represent that you meet these requirements.
Some features require an account. You are responsible for keeping your credentials secure and for all activity under your account. Provide accurate information and keep it up to date. Notify us promptly of any unauthorized use.
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial use, subject to these Terms and the rules of the app store you downloaded it from.
You may not copy, modify, reverse-engineer, decompile, resell, or create derivative works from the App, except to the extent this restriction is prohibited by law.
XPGym is offered through paid subscription plans (currently "Adept" and "Ascendant"). Prices, billing periods, and included features are shown in the App before you purchase.
The App provides general fitness tracking, gamification, and estimates (such as BMI, BMR, body-fat, and AI-generated workout suggestions). It does not provide medical advice and is not a medical device. The content is for informational and motivational purposes only.
Always consult a qualified physician before starting any exercise program, especially if you have a medical condition, are pregnant, or are unsure of your fitness level. You exercise at your own risk and assume full responsibility for any injury or harm. Stop and seek medical help if you feel unwell.
Some features generate workout suggestions using third-party artificial-intelligence services. AI output may be inaccurate, incomplete, or unsuitable for you. It is not professional, medical, or personal-training advice. Review any suggestion and use your own judgment before acting on it.
The App includes social features (handles, activity feeds, comments). You are responsible for content you post and must not post anything unlawful, harassing, hateful, infringing, or otherwise objectionable. We may remove content and suspend or terminate accounts that violate these Terms, without notice.
There is no tolerance for abusive or objectionable behavior. You can report or block other users, and we may act on reports at our discretion.
The App, including its design, text, graphics, ranks, and gameplay systems, is owned by Nullset Studio or its licensors and is protected by intellectual-property laws. Exercise images and certain exercise data are provided by third parties under their own licences. You retain ownership of the content you create; you grant us a licence to host and display it as needed to operate the App.
The App is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that data will always be preserved.
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill, arising from your use of the App. Nothing in these Terms limits liability that cannot be limited by law (including liability for death or personal injury caused by negligence, or your statutory consumer rights).
You may stop using the App and delete your account at any time from the in-app settings. We may suspend or terminate your access if you breach these Terms or where required by law. Provisions that by their nature should survive termination will continue to apply.
We may update these Terms from time to time. We will update the "last updated" date and, for material changes, provide notice in the App. Continued use after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the country in which the Operator is established, without regard to conflict-of-laws rules, and subject to any mandatory consumer-protection rights you have in your country of residence.
